Article 1. Applicable conditions
1.1 Various training courses, programs, and workshops (hereinafter: Training Courses) can be purchased from Dutch Nail Cosmetics through the Dutch Nail Cosmetics webshop, which participants then attend on-site at Dutch Nail Cosmetics. These "Training Terms and Conditions" apply to these Training Courses, in addition to the existing general terms and conditions of Dutch Nail Cosmetics. These terms and conditions are provided upon purchase of the Training Course.

Article 2. Training
2.1 The Training Courses offered by Dutch Nail Cosmetics can be found on the website: https://dutchnailcosmetics.com/pages/opleidingen (hereinafter: Website).

2.2 Dutch Nail Cosmetics is entitled to change the range of Training courses at any time.

2.3 Dutch Nail Cosmetics will make every effort to provide the Training Courses to the best of its ability and guarantees that it will fulfill the agreements made on time and in full, subject to exceptions, all in accordance with the laws and regulations.

2.4 Dutch Nail Cosmetics offers Training Courses to both individuals and professionals operating a business or enterprise. Some Training Courses are exclusively for professionals. If this is the case, it will be stated in the Training description. If a participant registers for this Training Course, Dutch Nail Cosmetics may assume that the participant is a professional.

2.5 Dutch Nail Cosmetics trusts that the participant, upon entering into this agreement, will provide all information and data—including any prior training—truthfully. If the participant provides incorrect, inaccurate, or insufficient information or data, Dutch Nail Cosmetics cannot be held liable in any way for any damage whatsoever, nor for the unsuccessful completion of the Training, or for disappointing results. If the participant causes (or has caused) damage, which can logically be the direct or indirect result of providing Dutch Nail Cosmetics with incorrect or incomplete information, Dutch Nail Cosmetics may hold the participant liable for the full amount of the damage.

2.6 Participant may only take the Training in their own capacity and is not entitled to transfer the Training in whole or in part to third parties, unless they receive permission to do so from Dutch Nail Cosmetics.

2.7 Dutch Nail Cosmetics reserves the right to remove a participant from the salon during the Training if the participant behaves inappropriately towards (staff of) Dutch Nail Cosmetics or other participants, or intentionally or culpably damages (equipment in) the Dutch Nail Cosmetics salon. In such cases, the participant is not entitled to a refund.

2.8 As indicated in the Course offerings on the Website, participants are required to bring a model to some Courses. If a model is required, this is clearly stated in the Course offering/description on the Website. The model is necessary for performing the treatments the participant will learn during the Course. If the participant does not bring a model, Dutch Nail Cosmetics will endeavor to find an alternative solution, but is not obligated to do so and assumes no responsibility or liability in this regard. If no model or alternative solution can be found, the participant may, in some cases, work independently.

Article 3. Registration for Training
3.1 Participants can purchase a Training Course through the webshop on the Website and register for a date made available there. Dutch Nail Cosmetics reserves the right to reschedule the dates of the Training Courses at any time.

3.2 The duration of the Course, as well as its start and end times, vary by Course. This information can be found in the Course description on the Website.

Article 4. Completion of Training
4.1 Upon successful completion of the Training, the participant will receive a certificate. This certificate has no (legal) legal value. The certificate serves only as proof of participation and successful completion of the Training.

4.2 Dutch Nail Cosmetics reserves the right to freely assess whether a participant successfully completes the Training and receives a certificate. In this assessment, Dutch Nail Cosmetics will consider, among other things, the application of the pre-treatment, the general application of the treatment, and the result of the treatment.

4.3 Dutch Nail Cosmetics also monitors the participant's progress during the Training. If Dutch Nail Cosmetics suspects early on that the participant will not successfully complete the Training within the training period, Dutch Nail Cosmetics will consult with the participant. In that case, Dutch Nail Cosmetics will advise the participant to take an additional lesson or discontinue the Training. If the participant discontinues the Training prematurely on the advice of Dutch Nail Cosmetics, Dutch Nail Cosmetics will refund the remaining Training fee to the participant.

Article 5. Payment and down payment
5.1 Different rates apply for the various Courses. The fees listed on the Website are exclusive of VAT.

5.2 A deposit of €100.00 excluding VAT is required for each Training. The deposit is paid by the participant when registering for the Training via the website.

5.3 If the participant cancels the Training and/or does not appear for the Training, the deposit will not be refunded to the participant.

5.4 The remaining balance must be paid by the participant on the (first) day of the Training. Payment must be made at the Dutch Nail Cosmetics salon before the start of the Training.

5.5 For some Courses, participants can pay the remaining outstanding amount in installments. The website will specify if and under what conditions this is possible. Payment in installments incurs an additional cost of 10% of the course fee. For the "Acrylic Gel Dutch Nail Cosmetics Course 8 Days" payment in installments, the first installment is paid on day 1 of the Course and the second installment on day 4 of the Course.

5.6 To participate in the Training Courses, it is necessary to use Dutch Nail Cosmetics products. Dutch Nail Cosmetics offers various packages. Without Dutch Nail Cosmetics products, the participant cannot participate in the Training Course. If it is necessary to purchase Dutch Nail Cosmetics products, this will be clearly indicated in the Training Course description on the Website.

5.7 If and as soon as the participant registers for a Training, she accepts the payment obligations that arise at that time and accepts that she must purchase the necessary products from Dutch Nail Cosmetics for the Training.

Article 6. Cancellation, changes and no-show
6.1 If the participant cancels the Training or changes the date, the deposit of €100.00 excluding VAT will not be refunded.

6.2 The date of the Training can be changed free of charge at the request of the participant up to 20 days prior to the training day.

6.3 If the participant purchases the Training as a consumer, they may cancel the agreement at any time without Dutch Nail Cosmetics charging any (cancellation/amendment) fees. However, in the event of early termination of the agreement by the participant, Dutch Nail Cosmetics will charge a reasonable fee, which will depend on the costs Dutch Nail Cosmetics has already incurred for the upcoming Training. This fee will include, among other things, the costs of the training materials.

6.4 If the participant enters into the agreement for the Training with Dutch Nail Cosmetics in their capacity as a company, the participant may not change and/or cancel the agreement prematurely without Dutch Nail Cosmetics charging the participant cancellation/amendment fees – in addition to the costs already incurred by Dutch Nail Cosmetics. These fees depend on the time at which the agreement is changed/cancelled. If the participant wishes to change or cancel the Training less than 20 days before the date of the Training, Dutch Nail Cosmetics is entitled to charge the participant the following fees according to the following schedule:

Time of change - change/cancellation costs

< 20 days before the start of the training - 10% of the training costs

< 10 days before the start of the training - 20% of the training costs

< 7 days before the start of the training - 25% of the training costs

< 5 days before the start of the training - 35% of the training costs

< 3 days before the start of the training - 40% of the training costs

< 1 day before the start of the training - 50% of the training costs

During the training - 50% of the training costs

6.5 If the participant fails to appear for the Training without prior notice, Dutch Nail Cosmetics may also charge the participant 50% of the training costs.

Article 7. Confidentiality

7.1 The Participant shall keep confidential all information received from Dutch Nail Cosmetics (in any form whatsoever), except and insofar as the Participant needs it for the performance of their duties/what they have learned during the Training. The Participant shall take all possible measures to ensure compliance with this clause. The same applies to all information (in any form whatsoever) concerning Dutch Nail Cosmetics that the Participant knows or could reasonably suspect to be secret or confidential, or that they could expect to be harmful if disseminated. The confidentiality obligation applies for the duration of the Training and for a period of 5 years after its completion.

Article 8. Intellectual property
8.1 Dutch Nail Cosmetics reserves all intellectual property rights, including but not limited to copyright, patent rights, trademark rights, design and model rights, etc. on all designs, drawings, writings, data carriers or other information, quotes, images, sketches, models, mock-ups, etc., unless the parties unambiguously agree otherwise in writing.

8.2 The Participant may not copy, show to third parties and/or make available to third parties or use in any other way any training materials obtained during the Training without the prior written and unambiguous permission of Dutch Nail Cosmetics.

8.3 Participants are prohibited from taking photographs of Dutch Nail Cosmetics employees, customers, and prizes during the Training, unless otherwise indicated by Dutch Nail Cosmetics.

Article 9. Penalty provision
9.1 If the participant acts in violation of any provision of these terms and conditions, but specifically in violation of the provisions of Articles 6 and 7 of these terms and conditions, this penalty provision will apply.

9.2 In the event of a violation of any provision, the participant will fully indemnify Dutch Nail Cosmetics for all damages, costs, losses, and liabilities resulting from the violation. In addition to compensation, the participant will owe Dutch Nail Cosmetics an immediately payable penalty of €500.00 per violation, plus a penalty of €150.00 per day (or part day) that the violation continues. Dutch Nail Cosmetics reserves the right to prove higher damages.

Article 10. Consequences of nullity or voidability

10.1 If any part of this agreement is void or voidable, this will not affect the remaining provisions of this agreement. The void or voidable provision will then be replaced by a provision that comes closest to what the parties intended at the time they concluded the agreement.
